SAM*INK® Legal Intellectual Property Policy

Q1: How has SAM*INK® changed its Intellectual-Property (IP) protection?

SAM*INK® has announced that it will extend its already strong IP protection, commonly called IP indemnification to cover all authorized franchisees & licensed end-users using a wide range of current & earlier versions of products like micro-chips, water-based inks, & low-solvent inks.

Previously, indemnification was provided to authorized franchisees. Now all licensed end-user customers who have acquired their licensed products through one of our authorized franchisees have IP protection from SAM*INK®.

SAM*INK®'s protection covers the four forms of intellectual property (trademark, copyright, trade secret, & patent), & covers defense & damages for a covered claim. The bottom line is that we stand behind what we sell & want customers to have the peace of mind they deserve.

Q2: Why is IP protection important?

Unfortunately, we live in a world in which a dispute over property can result in a lawsuit. IP protection is a valuable offering that SAM*INK® extends to end-users of its covered products. If someone alleges that the products you purchased from our authorized franchisees infringes on their intellectual property rights, then we will help protect you from the legal costs & liability associated with the dispute.

The fact is that technology is very complicated & intellectual property issues are very real. One has only to look at the recent cases in any growth industry to know that there is a level & degree of risk that is out there. SAM*INK® has never been the recipient of any litigation involving IP; but we know that diligent preparation & the ever-careful & clear avoidance of it is much better than the cure.

Given these examples, it is very important to know that not all ink companies provide IP protection. And those that do may have less comprehensive coverage than you might otherwise assume.

We want end-users of SAM*INK® to have confidence that they are not unnecessarily exposing themselves to IP problems by using our products. We help protect our end-users from intellectual property risk by offering strong IP protection.

Q3: How do I take advantage of this?

End-users purchasing any licensed SAM*INK® products from an authorized franchisee are automatically covered by our IP protection. Customers shouldn't have to fill in forms to get coverage for their ink solutions & we are not going to make them.

Q4: Why is SAM*INK® doing this?

Our customers need their inks to work for them & they don't have the time or the interest in worrying about whether their inks has all the appropriate IP rights. SAM*INK® wants our end-users to have confidence that they are not unnecessarily exposing themselves to IP problems by using our products. We believe that standing behind our customers & helping protect them from risk is a responsible thing to do. We feel comfortable making this stand because we carefully manage the IP rights needed to ship our products.

Q5: How much does SAM*INK® charge for its IP protection?

There is no separate charge for the protection we offer our end-users; it is included in the price they pay to purchase or license the product from an authorized franchisee. SAM*INK®'s strong IP protection is part of the overall value we provide to end-users of our inks, & customers are seeing this as a key differentiator in their selection of our IP products.

Q6: Your cartridges are illegal?

As with any business concern, our jealous competitors would attempt to verbally defame us. Do not be fearful. Courteously ask for his name, the organization he represents, and if he is prepared to write it on paper and defend his words in a court-of-law. Printer warranty issue seems to be a non-issue since legislation has been passed that states printer warranties are to be honored even if aftermarket ink is used:

MAGNUSON-MOSS WARRANTY IMPROVEMENT ACT United States Code Annotated Title 15 Commerce and Trade Chapter 50 Consumer Product Warranties 15 Section 2302 “(c) No warrantor of a consumer product may condition his written or implied warranty of such product on the consumer's using, in connection with such product, any article or service (other than article or service provided without charge under the terms of the warranty) which is identified by brand, trade or corporate name; except that the prohibition of this subsection be waived by the commission if: 1) The warrantor satisfies the Commission that the warranted product will function properly only if the article or service so identified is used in connection with the warranted product, and 2) the Commission finds that such a waiver is in the public interest.” This is your lifesaver for purchasing your inkjet cartridges at wholesale prices. Under no circumstances may any company or associate, salesperson or service technician deny you service or warranty work that would otherwise be covered under the warranty program.
